These Terms of Use ("Terms") are an agreement between you and Fly-Right LLC ("Fly-Right," "we," "us"), a New Jersey limited liability company, governing your use of the CabinCue iOS application and its related services (together, the "Service"). CabinCue was previously published under the name CabinKit; these Terms apply to the app under either name. By downloading, accessing, or using CabinCue, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
CabinCue is a professional organization tool for business aviation flight crew and cabin crew. It provides cabin and galley checklists, inventory and stocking management, trip organization, expense tracking with receipt attachments and PDF reports, crew document storage, reference materials for beverages and catering, passenger-preference profiles, and an optional professional community.
2. Eligibility
You must be at least 17 years old and legally able to enter into this agreement to use the Service. The Service is intended for working aviation professionals and is not directed to children.
3. Aviation Safety — Advisory Content Only
Nothing in CabinCue is operational guidance. Checklists, stocking lists, procedures, and reference materials in the Service are organizational aids only. They do not replace, supersede, or amend aircraft OEM documentation, the approved Airplane Flight Manual, cabin systems manuals, or your operator's approved procedures. Where any difference exists, official documentation and the pilot in command govern. Weather information in the Service is for general awareness and must not be used for flight planning or operational decisions.
4. Subscriptions and Billing
- The Service is offered through auto-renewing subscriptions ("Essentials" and "Pro"), billed through your Apple ID.
- Every plan begins with a 7-day free trial. The subscription renews automatically at the end of the trial and each period unless you cancel at least 24 hours before the current period ends, in Settings → Apple ID → Subscriptions.
- All billing, cancellation, and refunds are handled by Apple under Apple's terms. Fly-Right cannot issue refunds for purchases made through Apple.
- We may change pricing or the features included in each tier prospectively; changes do not affect a period you have already paid for.
5. Your Content and the Community
The Lounge community lets you post and share content under a pseudonymous handle. Do not include client-identifying information of any kind — no passenger names, no tail numbers, no itineraries, no contact details of principals.
- For content you choose to share to the community, you grant Fly-Right a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content within the Service. You can delete your own posts and replies, and withdraw items you have shared to the Library, at any time in the app.
- Library submissions (checklists, recipes, meal templates, vendor listings) are reviewed before publication. Community posts publish immediately and are moderated after the fact; reported content is reviewed within 24 hours.
- No vendor pays for placement, ranking, or endorsement in CabinCue — ever.
- You agree not to post content that is unlawful, defamatory, harassing, discriminatory, obscene, misleading, or infringing of any third party's rights.
6. Passenger Profiles, the Crew Vault, and Shared Stocking
- The profiles feature is designed for code names and service preferences only. Do not enter legal names, government identifiers, or other information that identifies a passenger. The app warns when an entry appears to be a real name.
- Profiles are stored encrypted on your device and have no export or share function. The optional crew vault syncs profiles between the keyholders you invite, end-to-end encrypted through Apple iCloud; the vault owner controls the participant list, and removal takes effect immediately, enforced server-side.
- Shared tail stocking uses a separate invite list per aircraft, is end-to-end encrypted, and carries stocking data only.
- You are responsible for ensuring your use of these features complies with your employer's and clients' confidentiality requirements.
7. Acceptable Use
You agree not to: (a) use the Service for any unlawful purpose; (b) probe, scrape, disrupt, or overload the Service or its infrastructure; (c) reverse engineer the Service except where the law permits it notwithstanding this limitation; (d) misrepresent your identity or affiliation; or (e) resell or commercially redistribute the Service.
8. Third-Party Services
The Service relies on third-party services, including Apple iCloud/CloudKit, Apple WeatherKit, community product databases (such as the Open Food Facts family and UPCitemdb), and optional scheduling-provider calendar feeds you connect. The availability and accuracy of third-party services are outside our control, and their terms govern your use of them.
9. Intellectual Property
The Service, including its design, text, graphics, and software, is owned by Fly-Right or its licensors and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the app on Apple devices you own or control. If you send us feedback, we may use it without obligation to you.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLY-RIGHT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR $50, WHICHEVER IS GREATER.
12. Indemnification
You agree to indemnify and hold harmless Fly-Right and its members, officers, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from content you post, your violation of these Terms, or your violation of any law or third-party right.
13. Termination
You may stop using the Service at any time; deleting the app removes its data from your device. We may suspend or terminate your access to the Service if you violate these Terms. Sections that by their nature should survive termination (including Sections 5, and 9 through 12) survive.
14. Changes to the Service or Terms
We may modify the Service or these Terms. If we make material changes, we will update the effective date above and ask for your acknowledgment in the app. Continued use after changes take effect constitutes acceptance.
15. Apple App Store Terms
These Terms are between you and Fly-Right only — not Apple. Apple has no obligation to provide maintenance or support for the app and is not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list. To the extent these Terms conflict with Apple's Licensed Application End User License Agreement, Apple's terms control for that conflict.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the state or federal courts located in New Jersey, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the remainder stays in effect.
